Divorce mediation has many benefits, and can effectively be utilized for any and all issues related to divorce and legal separation including property settlement, asset and debt distribution, child custody, parenting plan, retirement and spousal support.

The Role of the Divorce Mediator is many-fold:

Assess

To work with the clients to assess and identify the issues and topics that need to be resolved from the point of view of the clients, the family court system requirements, and the mediator’s experience of best practices for a clear and durable agreement for preventing future conflict. This includes consideration for the well-being of any children or other dependents impacted the divorce or separation.

Educate

To share information and provide or suggest additional information sources to that clients understand the legal context, affects, and the range of options for the decisions they need to make.

Guide Discussion

To establish the agenda, structure and guide the client’s discussion towards specific, practical agreements, utilizing a variety of conflict resolution and problem-solving skills.

Coach Communication and Negotiation

To coach and assist the clients in effectively communicating their goals and values, in understanding each other’s perspective, and in productively negotiating with each other.

Take Notes and Write Agreements

To track and clarify both agreements made and agreements that need to be made, and to write the 4-12 page “Settlement Agreement.”

Advise on Substantial Matters

While the mediator will never tell the clients what they should do, or advocate a particular outcome, they can offer advise for things to consider for optimizing the outcome or avoiding pitfalls in parenting, financial and tax implications of what is being discussed.

Provide Referrals

The most competent mediators know when to encourage clients to seek additional professional support for emotional, financial, and legal matters, and can provide clients with trusted local referrals.
